Terms & Conditions of GravoMax Fitness

These Terms and Conditions outline the rules and guidelines under which GravoMax Fitness products and services are provided. By accessing our website or making a purchase, you acknowledge and agree to these terms. The sections below explain how our products, services, and responsibilities are defined.

Nothing in these Terms is intended to limit your rights under the New Zealand Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
1. Orders & Acceptance ▾
- All orders placed through our website are offers to purchase and are subject to availability and confirmation by us.
- If we need to cancel an order (for example, due to stock issues, pricing errors, or other genuine mistakes), we will notify you promptly and provide a full refund of any amounts paid.
- Orders cannot be changed or cancelled once they have been dispatched.
- Some items may be offered as Pre-Order or Special Order. Additional terms (including estimated timeframes and cancellation restrictions once production has begun) apply to these products as set out on the relevant product page and our Shipping & Pick Up page, and are always subject to your rights under New Zealand law.
2. Pricing & Payment ▾
- All product prices on our website are in New Zealand dollars (NZD) and include GST.
- Shipping charges shown at checkout also include GST, unless clearly stated otherwise.
- Prices may change from time to time; the price shown at checkout at the time you place your order is the price you will be charged.
- We accept major credit/debit cards, bank transfer, and other secure online payment methods that may be displayed at checkout.
3. Shipping & Delivery ▾
- We deliver to physical addresses within New Zealand only (no PO Boxes). Additional charges may apply for rural addresses, islands, bulky deliveries, or special delivery requests.
- Most standard deliveries (processing + transit) are expected to arrive within 3–7 business days, but delivery timeframes are estimates only and may be affected by courier capacity, severe weather, or other factors outside our control.
- Large and bulky items are generally delivered via curbside freight services. Freight drivers are not required to carry items inside your home or up stairs.
- From time to time, we may offer shipping promotions (for example, free standard shipping above a certain order value for selected regions). The applicable terms will be shown at checkout and do not limit your rights under the Consumer Guarantees Act.
- Once your order has been delivered to the delivery address you provided (and not rejected for a valid reason), risk and responsibility for the goods pass to you, except as otherwise required by New Zealand law.

4. Installation ▾
- Assembly and installation services are currently available within selected Auckland areas only.
- Pricing depends on equipment type, access conditions, and your address. Any additional charges will be confirmed with you before the service is provided.
- Installation fees are generally non-refundable once the service has been completed, except where you are entitled to a remedy under the New Zealand Consumer Guarantees Act or other applicable law.
5. Returns & Exchanges ▾
- We offer a 7-day change-of-mind return on eligible items. Products must be unused, in resellable condition, and returned with all original packaging, manuals, hardware and proof of purchase.
- Change-of-mind returns are not available for:
- Customised or made-to-order equipment;
- Clearance or sale items that are clearly marked as non-returnable for change of mind;
- Products that have been assembled, installed, or used;
- Items that are not in a condition suitable for resale as new (for example, missing parts or original packaging).
- For change-of-mind returns or size/style exchanges, return shipping and any delivery costs for the replacement item are the customer’s responsibility, unless the return is due to our error.
- In-store returns at our showroom are free for eligible items. Courier returns must be arranged in line with our return instructions.
Our change-of-mind returns are offered in addition to, and do not replace or limit, your rights under the New Zealand Consumer Guarantees Act and the Fair Trading Act for faulty or misdescribed goods.

6. Damaged or Faulty Goods ▾
- If your order arrives damaged or appears to be faulty, please contact us as soon as you can, ideally within 48 hours of delivery where practical, and include clear photos of the product and packaging. Please keep all packaging materials for inspection and courier claims.
- We will meet our obligations under the New Zealand Consumer Guarantees Act. Depending on the nature of the issue, this may include arranging a repair, replacement, or refund at no extra cost to you.
- Where a refund is the appropriate remedy under the Act, we will also refund any reasonable original delivery charges you paid and cover the cost of returning the product to us.
- These rights apply whether you purchased online or in store, including for clearance and assembled goods.
7. Warranty & Liability ▾
- Most GravoMax equipment includes a standard warranty against manufacturing defects, as described on the relevant product page or in our warranty information.
- Our warranties are provided in addition to, and not instead of, your rights under the New Zealand Consumer Guarantees Act.
- Warranty does not cover normal wear and tear, misuse, neglect, improper assembly, or use of equipment contrary to the instructions and intended purpose.
- To the extent permitted by law, GravoMax is not responsible for injury, damage, or loss arising from the incorrect use or modification of equipment.

8. Intellectual Property ▾
All website content, product descriptions, training images, and branding (including the GravoMax name and logo) belong to GravoMax Fitness or our licensors. You may not copy, reproduce, or reuse this content without our prior written permission.
9. Privacy ▾
We collect the personal details we need to process your orders, provide support, operate our website, and improve your experience. We may share your information with trusted service providers (for example, couriers, payment processors, and email platforms) and where required by law.

10. Governing Law ▾
These Terms are governed by the laws of New Zealand. Any disputes arising in connection with these Terms will be dealt with by the New Zealand courts, without limiting any rights you may have to raise a dispute through recognised dispute resolution schemes or regulators.
11. Changes to Terms ▾
We may update these Terms from time to time. The latest version will always be available on our website. By continuing to use our site or placing orders after changes are published, you accept the updated Terms.
12. Promotions & Discounts ▾
- Promotional offers and discounts are available for a limited time only and may be withdrawn or changed at any time.
- Unless specifically stated, discounts and promotional codes cannot be combined.
- Each promotion is subject to any additional terms stated in the associated advertising or on the promotion page.
- We reserve the right to cancel or refuse the use of a promotion where it has been applied in error or used in a way that is inconsistent with the stated terms, while still acting fairly and in accordance with New Zealand law.
13. Gift Cards ▾
GravoMax Gift Cards are digital vouchers that can be used on our website.
- Available amounts may include $50, $100, $200, $300 and other denominations as offered from time to time.
- Gift cards are emailed after payment and are generally valid for 12 months from the date of issue (see the specific expiry date on your gift card).
Conditions of Gift Cards
- Gift cards are generally non-refundable and cannot be exchanged for cash, except where required by law.
- Gift cards cannot be used to buy other gift cards.
- Please treat them like cash—lost or stolen gift cards cannot usually be replaced or refunded.
14. Force Majeure ▾
Events beyond our reasonable control (for example, natural disasters, strikes, pandemics, disruptions to transport networks, or major technical issues) may cause delays or failures in fulfilling orders or providing services. In such cases, we will act reasonably and do our best to keep you informed and minimise any impact.
